How can I verify a property in Lucknow?

Short answer

Check four things before you pay: who owns it (title deeds and land records), whether anything is registered against it (encumbrance certificate), whether it is approved for the use you want (authority approval, land use and, for projects, RERA registration), and whether anyone disputes it (court and authority records). Visit the site, and have an advocate review the documents.

Explanation

  1. Meet the owner and the property. Visit the site, see the boundaries and ask who is in possession. Check the identity of every owner against their documents.
  2. Trace the title. Collect the registered sale deed and the earlier deeds. Each should lead to the next, with no gap. Ask your advocate to read them.
  3. Check the land record. Look the plot up on UP Bhulekh by district, tehsil and village: the owner's name, the khasra number and the area should match the deeds. Confirm that mutation was done after earlier sales.
  4. Check for charges. Obtain an encumbrance certificate through igrsup.gov.in for the period your advocate advises.
  5. Check the approval. For a plot or building, confirm the layout or map approval with the development authority (such as LDA). Check the land use is the one you want.
  6. Check RERA for projects. If a builder or promoter is selling, find the project on up-rera.in and compare its details with what you were told. See how to check UP RERA details.
  7. Look for disputes. Ask your advocate to search court records (eCourts at ecourts.gov.in) and authority records for cases involving the property or the seller.
  8. Check dues. Property-tax receipts, and water and electricity no-dues.
  9. Put the deal in writing. Pay by bank transfer, sign an agreement that states the price, the payment schedule and the documents handed over, and register the sale deed. See registration.
